Court dismisses suit seeking to annul Adeleke’s nomination for Osun Governorship.

The complaint was dismissed by the judge on Thursday because the plaintiff lacked locus standi to bring it.

Justice Obiora Egwuatu of the Federal High Court in Abuja has dismissed a complaint seeking to overturn the submission of Ademola Jackson Nurudeen Adeleke’s name as the Peoples Democratic Party’s (PDP) gubernatorial candidate in the July 26 election.

The complaint was dismissed by the judge on Thursday because the plaintiff lacked locus standi to bring it.

Awoyemi Oluwatayo Lukman, the plaintiff in the claim, has hauled the Independent National Electoral Commission, INEC, the PDP, and Adeleke before the court, seeking an order to void and set aside Adeleke’s name submission to INEC on grounds of suspected unlawful activity.

The complainant complained that Adeleke’s name was submitted too quickly by the PDP on March 11 rather than between March 14 and 18, as required by INEC norms.

Because Adeleke’s name was not submitted within the time frame provided by INEC, the plaintiff urged the court to declare the submission illegal, unlawful, null and invalid, and to set it aside.

He argued that INEC must follow its established rules and that anything done outside of those standards violates the Electoral Act 2022.

However, in his decision, Justice Obiora Egwuatu dismissed the claim on the grounds that the named Awoyemi Oluwatayo Lukman lacked locus standi to bring the action.

The Judge further ruled that the complaint was statute barred since it was submitted beyond the 14-day deadline established in Section 285 of the 1999 Constitution, which states that all pre-election litigation must be filed within 14 days, however the instant suit was brought after 28 days.
